Here is a comprehensive Terms and Conditions (T&C) document tailored for MittiBite as a two-sided food marketplace.

This document is critical because it acts as your legal shield. Its primary job is to establish that Snazzerra Apps LLP is a technology platform, not a restaurant, thereby limiting your liability if a customer gets sick or a chef fails to cook.

1. Introduction and Acceptance

Welcome to MittiBite, a platform developed and managed by Snazzerra Apps LLP ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the MittiBite mobile application (the "App") as either a Customer ("Eater") or a Home Chef ("Maker").

By registering an account, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Nature of the Platform

MittiBite is an online aggregator and technology platform that facilitates connections between independent home-based cooks/chefs ("Chefs") and customers seeking home-cooked meals ("Customers").

No Agency: We do not cook, prepare, pack, or own the food listed on the App. The Chefs are independent contractors, not employees, partners, or agents of Snazzerra Apps LLP.

Liability Disclaimer: The Company acts solely as a facilitator. Any contract for the sale of food is strictly a bipartite contract between the Customer and the Chef. We do not guarantee the quality, taste, or hygiene of the food, though we enforce strict platform guidelines.

3. Account Registration

Eligibility: You must be at least 18 years old to create an account.

Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile updated.

Security: You are responsible for safeguarding your account credentials. The Company is not liable for any unauthorized use of your account.

4. Ordering, Time Slots, and Cancellations

MittiBite operates on a strict Pre-Order Model to eliminate food waste for our Chefs.

Cut-off Times: Orders must be placed before the designated cut-off time (e.g., 9:00 AM for Lunch). The App will automatically block orders once the cut-off time passes or a Chef's capacity is reached.

Cancellations by Customer: Customers may cancel an order or modify their subscription only before the designated cut-off time for a full refund. Cancellations made after the cut-off time will not be refunded, as the Chef has already begun preparation.

Cancellations by Chef: If a Chef cancels an accepted order due to an emergency, the Customer will receive a full refund to their original payment method or MittiBite Wallet.

5. Home Chef (Maker) Responsibilities

By listing meals on MittiBite, Chefs agree to the following:

Quality and Hygiene: You must prepare food in a clean, hygienic home environment using fresh, safe, and high-quality raw materials.

Compliance: You are responsible for obtaining any local health or food safety registrations (such as FSSAI registration in India) required to operate a home kitchen.

Accuracy: You must accurately describe your meals, including identifying potential allergens (e.g., nuts, dairy) and dietary tags (e.g., Jain, Veg, Non-Veg).

Fulfillment: You agree to have the food packed securely and ready for dispatch at the designated time slot.

6. Customer (Eater) Responsibilities

Allergies: It is the Customer's sole responsibility to communicate any food allergies or severe dietary restrictions prior to ordering. MittiBite does not guarantee that cross-contamination will not occur in home kitchens.

Receiving Food: Customers must be available to receive the delivery at the selected time slot. Failure to receive the food will result in order forfeiture without a refund.

7. Payments and Subscriptions

Transactions: All payments must be made through the authorized payment gateways provided in the App. Cash on Delivery (COD) may be offered at our discretion.

Platform Fees: Snazzerra Apps LLP reserves the right to charge a convenience fee, delivery fee, or platform commission. These will be clearly displayed before checkout.

Subscriptions: If purchasing a "Meal Pass" or weekly/monthly subscription, credits must be utilized within the specified validity period. Unused credits may expire as per the specific plan's terms.

8. Limitation of Liability

To the fullest extent permitted by law, Snazzerra Apps LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

We are not liable for any health issues, food poisoning, allergic reactions, or physical harm resulting from the consumption of food ordered through the App.

9. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms, receive consistent negative reviews (for Chefs), or engage in abusive behavior toward support staff, delivery personnel, or other users.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
